UPDATE: TMZ now adds that police have opened a domestic battery investigation, which is a misdemeanor.

Original: As we reported yesterday, David Otunga and Jennifer Hudson have split up after ten years of dating, with Hudon getting a restraining order against Otunga. At the time, a statement from Hudson’s representative did not accuse Otunga of being abusive. TMZ now reports that the order of protection was because Hudson believes that Otunga is a threat to her and their eight-year-old son David Jr. Hudson went to court yesterday without telling Otunga and got the order. The police went to their home, let Otunga pack a bag and told him to leave.

The couple have been split up for several months after Otunga allegedly discovered Hudson was dating someone else. He stayed in the family home, owned by Hudson, because he’s been the primary caregiver with her traveling so much. The two had been negotiating a custody arrangement over the last several weeks, but both wanted primary physical custody so the talks fell apart. Hudson demanded that Otunga leave the home, but when he didn’t, she got the order of protection. She’s filed a petition for full physical custody.

It only gets worse from there. TMZ also adds that Hudson is afraid that Otunga will physically hurt her, which he has denied. The details of the order of protection have Hudson’s claims that Otunga showed “aggressive, threatening and harassing behavior toward me.”

She said: “I am now living in fear of further action David might take.”

She said that on Wednesday, she was in a recording session with their son. Otunga called her several times but couldn’t get her. Instead, he asked their son to record what was going on. Otunga wanted her son to show she was dating one of her producers, which she’s denied. When she returned to their home, she claimed that Otunga was “visibly angry,” grabbed their son by the hand and pushed her out of the master suite. She said their son, a makeup artist and assistant all saw the incident take place.

Hudson claims that this is only the most recent incident in a series of moments of threatening behavior. She claims she’s worried because Otunga is a wrestler and happens to be 6’3″ and 240 pounds. She said at times, Otunga left a gun and holster on their kitchen counter. He claimed it was a movie prop.

She added: “David knows that I am and have been very sensitive to firearms after my mother and my brother were murdered by a firearm. I believe that he left it out to taunt, intimidate and frighten me, which he absolutely accomplished.”

The order of protection allows Hudson to keep their home and orders Otunga to keep away from her and her son. The custody petition asks for “significant decision-making responsibilities” as she’s been “solely responsible for making all major decisions” for their son. TMZ sources claim that it’s been Otunga. Otunga was not at the court when Hudson got the order and says she’s made up everything to gain custody of their son.
